Timmy Kinner Jr. will not face the death penalty after accepting a stipulated plea agreement in his first-degree murder case in Ada County.
Kinner, who in June 2018 was charged with stabbing a 3-year-old to death during a birthday party, and injuring eight others, all of whom were refugees, pleaded guilty to first-degree murder and a dozen other charges.
The Idaho Press reports, in exchange for Kinner’s guilty plea, Ada County agreed to withdraw its notice of intent to seek the death penalty.
Kinner will be sentenced to life in prison for first-degree murder and aggravated battery, the agreement stated. The sentences will run consecutively so that Kinner will be sentenced to two consecutive fixed-life terms on those counts.
